32. Thomas SORRELL

This spelling for SORREL is based on the signatures of the children who could write their own names on the estate settlement of Thomas in 1870. Millia, from this generation spelled it: SORREL.

In the next generation the additional L was added to avoid confusion with other SORRELS in the same community. It had to do with confusion over mail or a business account.

DNA results proves that our line is related to the documented line of Edward SORRELL b about 1730 and lived in Wake Co., TN.

I believe that Thomas and siblings are listed in their father's household as children in the 1810 Surry Co., NC Census and then father is in the 1820 Bedford Co., TN Census. Thomas' birthdate of 1803 is from the 1850 Census of Lincoln Co., TN. He is listed here as 37, 47, or 57 years old. I have split the difference. This is the only reference we have to his birthyear.

The Tax Lists from Bedford Co., TN that still exist are 1836-1839. Likely he will not be listed as the 1836 listing in Obion Co., TN indicate that he was there at this time.

Perhaps Thomas and wife, Elizabeth RUSSELL went to Obion Co., TN to care for her father then stayed to settle his estate.

1 Jan 1836, Obion Co., TN a deed record for the use of a field on Davison Creek on CONRAD land for the use of: in exchange for his fencing the area. Thomas signed with his mark.

Obion Co., TN Tax Lists for 28 Feb 1838, 1839, and 1840, and 1841 in District 7.

5 Jan 1839, he and Elizabeth Sorrels are listed on the Church membership records with the note (Dis) in the legend. 28 Jul 1832 lists the founding of the Republican Grove Baptist Church (originally called the Baptist Church of Christ at the Republican meeting house in Obion Co, TN.) They are not included as charter members. (Minutes of the Republican Grove Baptist Church, Obion Co., TN 1838-1860, Pub. No. 279, Microfilm no. 198 at the Nashville, TN State Archive Library).

Jul 1839 He is listed as an administrator on the estate of James Russell in Obion Co., TN. Elizabeth's brother, T. P. C. Russell is co-administrator. On the estate sale, he again signs with his mark!

Not found on the 1860 Census anywhere in TN although they were still living in Lincoln County, TN. I searched the neighborhood where they were living in 1850-but not listed in the 1860 Census. Seems those living in the PoGrab area are not listed on the census.

Heirs filing on behalf of minor child to distribute his estate on April 25, 1870.

5 Oct 1870 Children sell 154 3/4 acres (1/4 acre reserved for the family graveyard) to Henry NICHOLS. Registered 9 Dec 1870, Lincoln Co., TN.

Receipts for his burial and coffin are from the trunk of J. E. SORRELS.

His gravesite had no markers, just rock piles. He and 2nd wife, Elizabeth "Becky" RUSSELL and a child (probably Thomas, Jr.) are listed to be buried 3 1/2 miles NE of Petersburg, TN near Bedford, Marshall, and Lincoln Co. lines on the Elige Williams Place or Casteel property. Called the Sorrells' Cemetery. Our family placed an engraved headstone for Thomas and Elizabeth in July 1998. The graves are on a hillside across a deep gully of the Hannah's Gap Road in Petersburg, TN (Po-Grab). The area is covered with cemetery vine. It is behind a house there and to the right. There are 3 graves there and they are marked with rocks.

A letter written "From J. E. (James Edward) SORRELL, Petersburg, Lincoln County, TN, my father's name was Thomas Sorrells, he had a brother Edward. There is a large family of Sorrells in West Tennessee, at Dyersburg, James Newton Sorrells is one of them, as far as I know they are related to us." This is from the collection of Mrs. Pettigrew, Sorrells Original in the Pine Bluff, AR Library collection.(page 82)

33. Elizabeth RUSSELL

The Texas line lists her as Becky Russell.

A letter from her brother, T. P. C. "Thomas" RUSSELL in Obion Co., TN dated 26 May 1858 to Thomas addressed as brother-in-law stated that they owed some of the estate of their father to a man named John SISCO who lived in Stoddard Co., MO. He came for his share of Father's estate."

Another letter dated 1 Oct 1859. Refers to a James (T.P.C.'s oldest child was named James) coming to visit them soon and should bring any news. He again asks them for money in regard to their settlement with John Sisco on their father's estate. Copies of these letters were received from John and Sherry SORRELLS from a trunk of papers that belonged to Jack SORRELLS in PoGrab, TN.

Copy of a receipt: Received of Thos Sorrels by Gabriel Young $12 in full of my account for coffin this Apr 1 1868. signed by R. C. Blackwall. I believe that this would have been for Elizabeth. All of the children from the 1850 Lincoln Co., TN Census were still alive, except for son Thomas, Jr.. He was never married in Lincoln Co., TN as were his siblings. He did not appear in any other Census records. In 1868 he would have been 32 years old, but never listed as a landowner or Head of Household, therefore I believe he died prior to this 1868 date, and the coffin was for Elizabeth. $12 would be for a full-sized coffin.

The Hester Cemetery is two and one-half miles NE of Petersburg, TN in Wells Hollow. Turn left out of Petersburg onto Wells Hollow Road. Travel until you come to a populated area. Across from a broken down very old house on the left, there is an opening in the fence. You must unlatch the fence. The cemetery is extremely overgrown up the hill in the middle of the field under a clump of trees. Junior Wells is the owner of the land, and lives in the house to the right before you reach the area. This land is known as the SCOTT farm. You can also access it from the Three Hundred Dollar Road. He was wounded at the battle of Murfreesboro. He is listed as a private in Company C of the 8th Tennessee Infantry. The book said that Company C was comprised of men from Lincoln Co., TN.

44. Abner R. FREEMAN

From " John FREEMAN of Nolfolk Co., VA"- R. A. Freeman states that Abner was married 3 times and had 33 children. We know for sure of 4 marriages. The surnames of his wives were supposedly from a Mrs. Palmer. From Lincoln Co., TN Court records we have been able to piece together what is collected here. There is certainly room for correction and addition.

I have seen his middle name as Roundtree. His grandfather, Samuel and great uncle John had legal withnesses named Roundtree.

There is a death record in Bedford County (1834)? Someone said that one of the first wives names was Lurany.

Margy Sims told Grandmother (Vida Redd Sorrells) this is where the Indian blood comes into the Redd side of the family. She said that is was through the Freeman line. Cousin Charles MONK also confirms that his family always understood that Abner was Cherokee. Perhaps Nancy HAWKINS was Cherokee? Others say the REESE line. Patricia Linney states that she has always been told by her father that her great-great grandmother: Elizabeth Ann Freeman was full-blooded Cherokee.

The will of William Cunningham On April 6, 1829 William Cunningham executed a subsequent will, "revoking all others" "He appoints "my beloved wife Polly Cunningham and my brother-in-law Alexander Freeman, Executrix and Executor of this my last will and testament. " This shows that Alexander was a son of Aaron.

In the 1830 Census of Surry Co., NC, Cunningham’s wife, Mary “Polly” (William Cunningham’s will was recorded in the May court of Surry Co., NC in 1826.) is 3 households away from her brother-Alexander Freeman. He has a female living in his household age 60-69, and also has this same female in his household in the 1840 Census of Surry Co., NC (I believe her to be his mother- Nancy). This same Alexander Freeman names a son: Samuel Freeman (1850 Surry Co., NC Census).

Listed with the family is a Nancy BEARDEN age 27 with a daughter Josephine age 1 (Perhaps Nancy is a sister to Drucilla. A Nancy Glidewell married a William Bearden 10 December 1848 in Lincoln County, TN )

1860 Census of Lincoln Co., TN lists Drucilla, age 38 with the children.

Will recorded Lincoln Co., TN Will Book #2 , pg 85: signed 8 Mar 1850 with his mark. 1st I will that my just debts be paid out of my estate by him whom the court may appoint as administrator.
2nd I will that my homeplace being part of the tracts of land being more or less belong to my wife Drusilla & my minor heirs being six in number during her natural life or widowhood. But if she should marry then for the land to be rented out till the youngest child should come of age & after that it shall be sold & all of the six minors to have at least one hundred & fifty dollars before any of the rest of the children shall come in and as they come of age, my minors I want them to have their one hundred & fifty dollars and I want all my notes & accounts after collected and my just debts paid to be put out at interest for the schooling & raising of the children together with the ---- of the place. Thomas H. Bledsoe filed an inventory of Abner's estate with the court dated 7 Aug 1854.

Freeman is appointed guardian ad litern (friend of the court) for Moses, Achilles, James, Alexander, Mary A., Henderson, Martha A., and Altanta Freeman, children of Abner Freeman, and also of Abner and Mary Swinford-Lydia C., Eglentine, William, Perry G., Nancy R., & Mary F. Freeman to filed answers in this matter; and it further apprearing to the court, that publication has been regularly made for William Freeman, William Westerman & wife Hannah, William Martin & wife Jane, William Cunningham & wife Catharine and _________Moore & wife Sarah--and it further appearing that subpoenas & copy has been regularly served upon Drusilla Freeman, William H. Gibson & his wife Elizabeth, Saml. F & Daniel P. Freeman-and if further appearing that said parties have failed to plead, answer or demur to complaints bill acording to the rules of this court, the same is therfore, now, on this 28th day of February 1856 taken for confessed against them; and ordered to be set down and heard expartee as to them."

Charles A. FREEMAN - was appointed guardian of the minor children of Abner: James, Alexander, Mary A., Henderson, Martha A, Atlanta (Who I believe to be Agnes).

NOTE: Charles A. FREEMAN was also appointed guardian of Abner and Mary SWINFORD (apparently grandchildren of Abner) and Abner's known grandchildren, (the children of Andrew Jackson FREEMAN and wife Martha A. (Polly) as A J FREEMAN had died on 20 Dec 1845, and even though his widow, Polly, had married 8 May 1853 William Franklin MELSON): Lydia C., Eglentine, William, Perry C., Nancy R., and Mary F. FREEMAN.

Abner is buried at the top of a very high hill: Five miles NE of Petersburg, TN, west of Helton Hollow. This is accessed from Poor Grab Rd., crossing the fields and fences and climbing straight up the hill. Three graves there are marked with native fieldstones.

"When Abner Freeman died, Drucilla's brother-in-law, James Barham gave all his children: Charlie, Tom, and Ruth (Ruf) -parts of the farm, and left Drucilla with just a homestead". (Fanny Freeman Davidson) At the time the farm was called the "Freeman Branch", and then became known as the "Barham Branch".

Abner's estate records indicate that he evidently owed $2000+ and had enough cash to pay the debt down to $900+. One record indicates the court sent the county surveyor up to survey the farm and they were preparing to sell enough land to satisfy the debts. There are other documents but I ran out of time. In the tax records of 1851 he had 275 acres.

Jul 21, 1840 lists an Elizabeth FREEMAN to William H. GIBSON in Lincoln Co., TN. There is no return of the license. Also Jun 11, 1841 a Letha FREEMAN to a John CRITCHET in Lincoln Co., TN. Stephen Freeman m Ellen King 23 Aug 1846 Lincoln Co., TN

In my notes from conversations with my grandmother, Vida Redd Sorrells, she mentioned a Sarah J. Freeman who married William Owen Foster and went to TX. They were related to Ambrose Foster & Suzanne Medlin. (Perhaps these are their children.) Ambrose Foster from SC died in Lonesome Dove in Grapevine.

The land for the old cemetery at Mt. Hermon was sold by Abner of Lincoln Co., TN. According to early deeds, this appears to be a part of the old Higginbotham tract purchased by William Higginbotham in 1810 and 1811. On October 15, 1830, one acre of land was deeded to Isaac Bennett, Peterson Grammar, and Henry Dean and their successors in office as trustees of the Meeting House at Mt. Hermon. Included in this transaction was the meeting house and all improvements thereon. Witnesses were William C. FREEMAN and James FREEMAN.

I have seen his middle name listed as Roundtree.

I have searched the surname REESE/REES vertical files in the TN State Archives & Library, 2012.

Sally, his mother, is in Bedford Co., VA Census in 1830- in 1840 she is in Lincoln Co., TN (The land in VA is sold in 1831!)

Because Bedford Co., TN's early records were burned, it has been a challenge to find his first marriage paper trail. (We have proved a Court Houses in Bedford Co., TN were built in 1810, 1821, 1830, 1873, and 1935. The Court House was destroyed in 1830 by a tornado. In March of 1863 Confederate soldiers made a fire to keep warm, but it spread to engulf the old courthouse and destroyed most of the records. Again, in 1934 the courthouse was destroyed by fire.

10 Oct 1842 He purchases 3 tracts of land: 25 acres, 14 acres and 25 poles, and 15 acres in Lincoln Co., TN from Elijah Beard. Registered 19 Oct 1842. (Deed Book N-1)

Edmond owned 500 acres in 9th district and over 200 acres in 10th district Sevier County, TN. He settled in the NE part of the county, between Knoxville & Sevierville on Boyd's Creek close to Hwy 441, SE of Knoxville. In 1992, Mr. Ray Hodges of Knoxville, TN has the original Family Bible.


A lawsuit in 1851 had to do with settlement estate of Edmond - first execs were David McCroskey and Edmund Hodges, Jr. resigned and court appointed Samuel Pickens - his son William C. Pickens bought several shares and some of land rented to him by Samuel Pickens.

"John Ingle and his wife Sealie Ingle (she was full-blooded Cherokee) came to Sevier County sometime in 1840 from Union County, South Carolina. Their first child was my Great-Grandmother Louisa Jane Ingle (1835 or 1838). Her D.O.B. is in some dispute, but I choose to accept that on her grave marker as correct. They had three additional children that we know of...Sarah (1833), William (1835 ?) and James (1842). James is the only one we know of born in Tennessee. We know nothing of their day to day lives at this time." The quote above is from the email of Fred Wyrick.

There is a John Inglish in Abbeyville District, SC on the 1830 Census.
He is listed as 30-40, with a female 30-40 and 2 females under 5.

There are no INGLEs in the earlier Union Co., SC Census

There are other possiblities in 1840 of our John, but the Union County Census reflects the dates of his known children.

According to Cora Ingle Walker, they came to TN from NC driving their cattle over the Smoky Mountains.(Bits and Pieces of History about Smoky Mountain Foothills People: Ingle Families by Nora Harbin DeArmond 1990, Newsletter, Smoky Mountain Historical Society, Winter 1990, Vol XVI, No. 2, pg.98 Many photos of INGLE family. Large family group taken in 1910 of William INGLE family and friends.

According to family legend, this man married an Indian girl who had been abandoned and lived with them. (Marguerite Joyce Perdue Brown states that her mother and grandmother, Zora, told her of the Cherokee line being through her great, great grandfather.)

My grandfather, Fred Elmer INGLE, was one quarter Cherokee. (Sherry Sorrells Finchum)

Our John is listed in Cocke Co Census of 1850, place of birth for both he and Celia is SC. John is listed as age 36 which would make birthyear: 1814 and Celia is listed as age 29 birthyear: 1821.

It appearing to the court that John Ingle is improperly charged with a poll tax for the year 1858, it appearing to the court that he is over fifty years of age it is ordered by the court that he be released from said poll tax. (This may explain the change in age all of a sudden!)

He is listed beside Larkin MATHES who is age 50 also b in SC, with only the child age 4 listed as born in TN. The wife's name is Sarah, age 40 b in SC.

Sevier Co., TN Court Records 07-17-1866 State vs Ingle, John charge: Contempt

Several of the family members say he was from NC, but the Census records say SC. Family history is that he drove his cattle over the Smoky Mountains from NC. This is very likely true because the last SC record we have of the family is 1843. You must go through NC to get to TN where the family was in 1850!

In the Sevier Co., TN Vital Statistics their son William lists his parents birthplace as NC. He does list his father as John INGLE and his mother is listed as unknown. Caraline INGLE Hodges lists her father as John INGLE born in NC and her mother not given.

The 1880 Sevier County census listed William and Jane and their children Sarah -15, John -14, Celia 12, Nancy -10, Henry -10, Kyley -6, Martha -4, and Oliver -5/12.

John -85 and Celia -68 (who had cancer) had Sarah -43 living with them. John was only two houses away from William. On this census John lists his birthplace as TN and his parents both as Virginia. Celia and her parents were listed as being born in South Carolina. Sarah was also listed as being born in SC.

His dates are from his tombstone in Zion Hill Cemetery. The tombstone was evidently erected at his death several years after Celia had died because her date of death is listed on tombstone as 1879, but she was still alive in the 1880 Sevier Co., TN Census.

Her tombstone lists the year of death as 1879, as well as in William INGLE's Bible, but John's death is listed first (which indicates to me that hers was listed at the same time of John's death), but she is still alive on 4 Jun 1880 when the Census of District 10 was taken in Sevier Co., TN. Her date of birth is listed as 6 Apr 1813, but census records do not concur.

She is listed in 1880 as Celia, age 68 b in SC. In 1870 Sevier Co., TN Census she is listed as Clia, age 70 b in SC. In 1860 Sevier Co., TN she is listed as Caroline age 43, b NC, and in Cocke Co., TN Census of 1850 she is listed as Celia age 29, b SC, 1840: 1 female 20-30 born 1810-1820 (Celia herself)

Her name changes from Census to Census. Sometimes she is listed as Clia, Caroline, and Celia. I do believe that it is the same wife of John each time. The dates are not quite consistent, but...She is listed as Selia on her tombstone in Zion Hill Cemetery.

She is listed in the 1880 Sevier Co., TN Census as having Cancer.

54. Abraham "David" DICKSON

In later years, the family name began to be spelled DIXON. This was supposedly due to the fact that one of the grandchildren got into trouble with the law and this was the families attempt to disassociate themselves with that label.

I have seen his dates as the 20 Feb 1806-3 Aug 1873.

David Dickson became the guardian of 3 minor children of John Cutshall, Jr. in 1855.
Records indicate that they were his daughter Rebecca and John's children. Their names were David, William, and Henry. In the same book, there was a 14 year old named George Cutshall, son of Daniel Cutshall and another George Cutshall, son of John Cutshall, Sr. who was under the guardianship of a Ricker. All 4 children were given over to Jacob Harris in 1857. I believe that 1857 must have been when David and Elizabeth moved to Blount County, TN, and must have been required to have an agent residing in Greene County for the guardianship appointment.

56. Joseph CLARK

"The following is compiled partly from what has been related to me by my father, Berry William Clark and by others. Some from family records and some from data obtained by others: The Clarks are of Scott descent. The family migrated to England and later to America, first settling in VA, and there migrated to various places in America, mostly to the West. It is believed that they were several and that they well educated. Great Grandfather, Joseph CLARK, settled in South Carolina, in what year is not known probably somewhere around the late seventeen hundreds. The exact date of his birth is not know, but he died in 1853."(Newton Berry Clark Memories in 1958)

Another cousin reports that he was told by Fred Everitt CLARK that the family originally came from PA.

Sarah's birth is recorded as TN, therefore the family was in TN about 1805 0r 1806.

Minutes from Forks of the Little Pigeon River Baptist Church: "Wm...? was clirke up to Nov 1827. Joseph Clarke was clirke frome this date up to Sep 1833".

He served as the church clerk at the Forks of the River Baptist Church(now First Baptist Church) in Sevierville, TN from 1827-1833.

The CLARK Cemetery contains about 40-50 graves marked with fieldstones. No names can be read on the stones. It is located near the Little Pigeon River, about one-half mile west of Red Bank Baptist Church. To reach this cemetery, beginning in Sevierville at the intersection of US 441 and State Route 66, drive on US 411 (toward Newport) for 3.3 miles. Turn right onto Old US 411. Drive 0.6 miles and bear right onto Pittman Center Road. Drive 2.0 miles. The cemetery is on the right, about 400 yards at the top of the hill in a grove of trees. State of TN Land Grants: Bk 22, p. 272, No 22445 Randle JAMES 19 Nov 1835 28 Feb 1838 25 acres on the flat tract of Birds Creek. (Sev. Co. Entry No. 565 dated 20 Nov 1826)

Land survey in Sevier Co., TN dated 1838 would indicated that he was alive then, but dead before the 1850 Census was taken. The first date on the survey for 25 acres is 20 Nov 1826. Lying on Bird's Creek.

There is another document from Sevier Co., TN Deed Book that is Item # 22443 (or perhaps page) that is dated 20 Nov 1838 where land is surveyed.

Property sold to John Bitner CLARK from William stated there were four heirs to Randall's property.

Mary lists her mother as being born in VA and her father born in TN (from the 1880 Sevier Co., TN Census) John lists his mother as VA and his father as VA in the 1880 Census.

Information on Martha THURMAN is from "A Resume and History and Ancestoral Memories of the CLARK and PAINE Family" Compiled by Newton Berry CLARK in August of 1958. (Some from his memory, some from what he was told by his father, some from old family records, and some from records compiled by Martha GRAHAM, whose grandmother was Louisa E. She is listed on the 1840 Sevier Co., TN Census. A man that was a Revolutionary War Pensioner named Daniel Fox age 66 was living with her at this time. (Don't know of any relation.)

She is listed on the 1860 Sevier Co., TN Census with $200 Real Estate and $520 personal property.

She is probably the Martha JAMES in the 1870 Sevier Co., TN Census listed as age 79. She is still in the same neighborhood. She is listed as being b in SC-Her real estate is valued at $100 and personal property as $125. A Susen M. C. WATSON age 29 born in NC is living with her.

60. John PAINE

Memoirs of Smith Ferguson PAINE: "John Paine, the second son of Robert B. Paine, was my father. He married Mary Bradburn (my mother). Mary Bradburn was the daughter of Thomas and Elizabeth Bradburn. Elizabeth Bradburn's maiden name was Elizabeth Elledge. Thomas and Elizabeth Bradburn lived on and owned property known as Bradburn's Cross roads, and was located three miles west of where Taylorsville now stands.

"Father was a medium sized man, rather low of stature, five feet ten or eleven inches, weighing 165 pounds. A divided, or hair lip, otherwise was a very handsome man. He was a blacksmith by trade, and made bells in abundance. He was a very stout and active man, was hard to handle. He was very lively and loved sports and the chase. He was honest and strict in his dealing with men.

He wore a smile rather than a frown. A true friend, one who never forgot a favor, very sympathetic, ordinarily mild and gentle, but when insulted or injured, was revengeful, fearless and determined. Father loved his family and friends with a devotion that unsurpasses. No sacrifice too great or toil too hard for him if necessity demanded it. While working in the shop one day a sliver or scale of hot iron flew in his left eye, causing him to lose it. Some years later he lost the sight of his right eye. He was blind ten years before his death.

He served an enlistment in the War of 1812. He was at Horseshoe. I believe he reached the scene first just as the battle closed. He helped build a fort at that place.

During the winter of 1852, he became very much interested with regard to his future welfare and professed faith in Christ, joined the church and was baptized the first Sunday in May, 1853 by me, S. F. Paine."

War Records File (John Paine W. O. 7480). He volunteered in Burke Co., NC and served from Feb. 1, 1814 to Sept. 4, 1814 as private in Capt. James Martin's Company of NC Militia, against the Creek Indians. He was discharged at Salisbury, NC. He made 2 pension applications, one on 24 Aug 1850 and received 80 acres. Another application in 1852 and received 80 acres.

From: http://www.petuniapress.com/ml/19970131.txt MORE SUCCESSFUL LINKS: Some months ago Prodigy member Janet Randall (GYXA29B) posted a note on the Genealogy BB in the MILITARY SOURCES topic under WAR OF 1812 requesting a look-up in Virgil D. White's "Index to War of 1812 Pension Files." An entry was found indicating that her ancestor's widow had applied for a pension based on his War of 1812 military service and the file was at the National Archives (War of 1812 pension files have not been microfilmed). The entry in the printed index under the
heading PAINE reads: "John or John PAIN, Mary, WO-7480, srv Capt Martin's Co NC Mil." Here is Janet's report of the contents of
the actual file.

Here is the information I received from John Paine's 1812 pension.

1. Declaration of a Widow for Pension. This gives the following information: When she applied, where John died, when they were married and by whom. The regiment he served in, and a statement by Mary (the widow) Stating "That she does not remember any historical event in which he participated. That she believes her husband's discharge was sold to J.B. Sawyers at Ashville NC to obtain land warrant. Her application was approved.

2. A copy of his Bounty Land Claim -- "Form of Declaration for Survivng Officer or Soldier." He received this in 1852.
He gives his age, the county he currently resided in. His rank & company he served in.

3. A copy of his honorable discharge.

4. In 1855 he applied for additional bounty land under the act of 1855 & received that. (copy of these papers)

5. More papers showing his warrant numbers

6. Correspondence. This is great. This letter was sent fromSevierville TN to the Bureau of Information in Washington DC.

Letter dated Nov 13, 1939.

Dear Sirs: I read in the Knoxville paper that seventeen million dollars is unclaimed by war veterans and grandchildren of
veterans of the War of 1812 who may be beneficiaries. My Grandfather, John Paine, was born in Fairflax [sic] County,
Virginia in the year Feb. 11, 1789. He served in the War of 1812. His parents, Robert and Rachel Paine, moved to North Carolina
from Virginia in 1789. John Paine was at Horseshow [sic]. After the battle, he helped build a fort there. John Paine died March
28, 1866 and was buried at Turkey Creek Church, North Carolina. John Paine's wife's name was Mary Bradburn Paine. Their son,
Smith F. Paine, my father, was a veteran of the Civil War. Smith F. Paine was born April 22, 1837. He served in the Civil War and
received a small pension from the state. Smith F. Paine married Mary McIntyre. They moved to Tennessee from North Carolina in
1886. Smith F. Paine died Aug. 20, 1932.

Great-grandfather Robert Paine served three enlistments in the Revolutionary War, grandfather John Paine in the War of 1812, and
father Smith F. Paine in the Civil War. Can I receive benefits from these veterans?

(Note: Smith Ferguson Paine was the youngest of 15 children of John Franklin Paine, Sr. & Mary Bradburn. He was my GGG
Uncle. It amazes me that he was still living when my Father was born!)

The following is the letter she received in reply:

May 4, 1940

Dear Madam: Reference is made to your letter of April 29, in which you request the record of John Paine, whom you
described, previously, as having been born in Fairfax Co., Virginia, served in the War of 1812 from North Carolina,
married Mary Bradburn and died March 28, 1866. You are furnished herein the record of John Paine (surname shown also as Pain and Payne) as found in the papers of the claims under File No. W.O. 7480, based upon his service in the War of 1812.

The date and place of birth of John Paine and names of his parents were not stated. John Paine volunteered in Burke Co, NC
and served from Feb. 1, 1814 to Sept 4, 1814, as private in Captain James Martin's Co. of NC militia, against the Creek
Indians. He was discharged at Salisbury, NC

While a resident of Madison County, NC the soldier applied April 24, 1850, giving his age as 63 yrs, for bounty land which was due
on account of his service in the War of 1812. He was allowed 80a of bounty land on warrant number 47101 under the Act of Sept. 28,
1850. While still living in Madison County, he applied June 30, 1855, for additional land due for his service. He then stated he
was 65 yrs old, with no explanation of the discrepancy in ages. On that application he was granted 80a of bounty land on Warrant
#33504, under the Act of March 3, 1855. He died March 28, 1866 in Madison County, NC.

John Paine married April 8, 1809, [actual date 12 Apr 1810 from application for license] in Burke County, North Carolina, Mary Bradburn. The date and place of her birth and names of her parents are not shown. In 1871, soldier's widow, Mary Paine, was aged 78 yrs. and residing near Marshall, Madison County, North Carolina, with post office at Marshall.

It is not shown whether John Paine and his wife, Mary, had children.

In 1871, one A.L. Paine & Joseph Bradburn were residents of Marshall, Madison County, North Carolina. In 1871, one D.A. Paine
made affidavit in Madison County, NC. Their relationship to the soldier and his wife or to each other was not stated.

If you desire information relative to the location of the bountyland granted this soldier for his service in the War of 1812, you
should apply to the Commissioner of the General land Office, Interior Department, this city, and furnish that official the
number of each warrant, the acreage and date of the act under which issued.

61. Mary "Polly" BRADBURN

Mary (Bradburn) Paine, my mother, was rather above medium size, tall, erect. And well built, very stout, weighing from 130 to 135 lbs. She had dark complexion, long straight black hair, black eyes, deep and thoughtful. She was kind, tender and affectionate. She was of Swiss descent. Her great grandmother emigrated from Switzerland during the early settlement of this country. She was a flax spinner by trade.

Mother loved her home and her family. She was always interested in her children and was always doing something for their comfort. She was happiest when working for them or helping my father. She inherited her industrious nature from her ancestors. She was always busy, never idle. She worked much at night, carding, spinning, sewing, or knitting. She was a good cook and delighted in cooking a good meal and having a full table.

Mother was not very talkative, abominated laziness, was of good moral character, very high toned, adverse to vice or low society. She was very religious, humble, sincere and devoted to her Christian duty. She was a member of the Baptist Church which she attended regularly.

Mother was never ill very much, had some biliousness and sick headaches. Those were her greatest troubles. She had a good appetite and enjoyed her meals. She outlived my father six years and five months. During the summer of 1872 she gave away, grew more feeble each day, and some days she could hardly go.

On August 21st the Doctor came and said the end was near, her system was worn out. That night she was restless and I sent for the children that were within reach. Rachel came at once. On the 22nd she sat up part of the day, carded some cotton rolls, ate as usual, but on lying down she suddenly took bad again and about 10 o'clock she passed away. Next morning her sons, Anderson and Daniel, came for the burial. They started at dark one day and arrived there about 10 o'clock the next day. Turkey Creek is in Buncombe County, N.C. Her coffin was made by Martin White. We laid her to rest by her companion in life.

Thomas Bradburn, my grandfather, was a merchant farmer. He owned sixteen slaves and a considerable land. The Bradburns were of English descent. My grandfather gave my mother a slave but my father did not like negroes and returned the slave to Grandfather Bradburn.
